Welcome to MicroSaaSLink ("we," "our," "us," "the Company," or "MicroSaaSLink"). These Terms of Service ("Terms") govern your access to and use of our website at microsaasl.ink and all related services (collectively, the "Service"). MicroSaaSLink is a platform that helps users identify potential micro-SaaS opportunities by analyzing user feedback from existing SaaS products to find pain points that can be transformed into solutions.

2. Definitions

  • "User," "You," or "Your" refers to any individual or entity that accesses or uses the Service.
  • "Content" refers to all information, data, text, software, music, sound, photographs, graphics, videos, messages, or other materials that users submit, post, or display on or through the Service.
  • "micro-SaaS Ideas" refers to the business opportunities and concepts generated by our platform based on analysis of existing SaaS products.

3. Account Registration

3.1 Account Creation

To access certain features of the Service, you must register for an account. You may register directly by providing your username, full name, and email address, or through your Google account. When you register through a social login option, we collect the same information as with manual signup.

3.2 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Restrictions

Each individual is entitled to one account only. Account sharing is strictly prohibited. We reserve the right to terminate any accounts that we reasonably believe are being shared among multiple users.

4. Subscription and Payment

4.1 Subscription Options

We offer subscription plans that may be billed on a monthly or annual basis. Annual subscriptions may be offered at a discount compared to monthly billing.

4.2 Payment Processing

All payments are processed securely through our payment processor, Paddle. By subscribing to our Service, you authorize us to charge the payment method you provide for the subscription plan you choose.

4.3 Subscription Renewal

Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date. You may cancel your subscription at any time through your account settings.

4.4 Price Changes

We reserve the right to adjust pricing for our services at any time. If we change pricing, we will provide notice of the change on our website or by email at least 14 days before the change takes effect.

5. Refund Policy

5.1 Eligibility for Refunds

Refunds may be requested only if you have not generated any micro-SaaS ideas using our Service. Once you have used the Service to generate ideas, no refunds will be issued.

6. Service Usage and Limitations

6.1 Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

  • In any way that violates any applicable federal, state, local, or international law or regulation.
  • To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
  • To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.

6.2 Intellectual Property Rights

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by the Company, its licensors, or other providers of such material and are protected by Kenyan and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6.3 Usage Restrictions

You are prohibited from:

  • Copying, modifying, distributing, selling, or leasing any part of our Service.
  • Reverse engineering or attempting to extract the source code of our software.
  • Attempting to circumvent or overcome any technological protection measures intended to restrict access to any portion of the Service.

MicroSaaSLink does not guarantee that the micro-SaaS ideas generated through our Service will be successful or profitable. The success of any idea is solely dependent on your execution, market conditions, and numerous other factors beyond our control. You acknowledge that business success involves risk, and we make no promises regarding financial outcomes from using our Service.

8.2 "As Is" Service

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

9. Limitation of Liability

9.1 Exclusion of Damages

To the fullest extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

9.2 Liability Cap

In no event will our total liability to you for all claims arising out of or relating to the use of our Service exceed the amount you have paid to us for the Service in the past twelve months.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will immediately cease.

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice before any new terms take effect. What constitutes a material change will be determined at our sole discretion.

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Any legal action or proceeding arising out of these Terms shall be brought exclusively in the courts located in Kenya, and you consent to the personal jurisdiction of such courts.

16. Entire Agreement

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

19. Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. We may assign or transfer these Terms, at our sole discretion, without restriction.

20. Force Majeure

We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, riots, civil unrest, government action, labor disputes, or internet service provider failures.
